If you are evicting due to Violation of Lease, you are required to provide a Kapa Notice prior to the Notice to Quit can be serviced to allow the tenant to fix the violation. If you service the Notice to Quit without this, the Court will withdraw the case.
Requires a 3 day grace period OR 30 day grace period if you have any federally backed loans or Section 8 tenants.
Once you have Marshall service on the Notice to Quit, the Complaint can be drafted. You will be required to provide ample time for service and being able to return to the Court all servicing Documents by a deadline date, if dates are not proper, reservice of documents will be required.
